12 years for abusing two minors, recording women and distributing paedophile material

Alicante

Twelve years and one month in jail were given to a man by the Third Section of the Alicante Provincial Court for abusing two minors, recording several women in the bathrooms of their homes, and making and giving out paedophile material.

The High Court of Justice of the Valencian Community (TSJCV) says the accused has been found guilty of six crimes related to finding and telling secrets, two crimes related to sexual abuse of a minor, and crimes related to making child pornography and having and giving away child pornography.

Besides that, the man has to pay the two women who were abused 15,000 and 20,000 euros each in legal liability. Five thousand euros will be given to each of the other victims, who were women and adults and were taped in the privacy of their own homes.

During the December 11th trial, the prosecution, the private prosecution, and the defence of the man who was later found guilty all agreed on the facts that were proven, how they should be interpreted legally, and the sentence that should be given.

The events started in 2009 when the suspect started dating a woman. They were together until 2017, and during that time he lived with her and her two young children in different homes in Dénia (Alicante).

The man put a hidden video camera in the bathroom of these homes so that children or people who sometimes visited could see what was going on.

The device took private pictures of the prisoner’s partner and her 12-year-old daughter, as well as another child who lived in the house and used it, and saved the pictures on a computer.

The accused started seeing another woman with two young girls at the end of 2017. In 2019, he moved in with them in a house in the city of Dianense.

As in the first case, the guy who was found guilty recorded his partner having sex without her permission and saved the video to his phone.

He also touched the woman’s two young daughters when they were between 5 and 6 years old and 7 and 8 years old. He recorded these sexual acts and saved the edited pictures on a computer with child abuse content.

In January 2021, a neighbour asked him if he could change a light bulb in the bathroom, to which the convict agreed and took advantage of this circumstance to also install a hidden camera under the sink in that bathroom.

The device also took private pictures of the renter’s daughter and herself, in which they both looked naked.

On March 9, 2021, the defendant’s home was broken into and searched. Several computers, hard drives, and cell phones were among the electronic devices found. These were used by the man to store a lot of paedophile audiovisual files for his own use and to share with other people.

The decision was made orally, and it was made official at the hearing itself when both sides said they would not be appealing it.

Three years in prison for causing a traffic accident in Pinoso that killed two

Alicante Provisional Court

A driver has been sentenced to three years in prison by the Third Section of the Alicante Provincial Court for exceeding the speed limit while intoxicated and testing positive for cocaine. This also resulted in an accident that resulted in the deaths of a couple, aged 83 and 78, and the injury of their 11-year-old granddaughter, who was travelling in a separate vehicle. The incident took place in Pinoso in July 2020.

The individual who was convicted has entered into a plea agreement and has been sentenced for crimes against road safety, reckless homicide, and injuries.

The tragedy took place at an intersection in the heart of Pinoso, near the Rico Lucas speed bump. The vehicle in which the victims were travelling collided sideways with the driver, who was subsequently convicted, as he was travelling at a rate of over 90 kilometres per hour at the time, despite the fact that the speed limit was 30 kilometres per hour.

Following the acknowledgement of responsibility for the crime and the agreement reached with the family of the deceased regarding the payment of financial compensation as a mechanism for reparation for the damage caused, based on civil liability, the Prosecutor’s Office initially requested a six-year prison sentence. However, this sentence was reduced by half.

He was also sentenced to a six-year driving ban in addition to the prison sentence. His vehicle was also confiscated.

Elche mother sentenced to 19 years for the murder of her son and the abuse of her twins

Alicante

A woman has been sentenced to a total of 19 years and seven and a half months in prison by the Jury Court of the Seventh Section of the Alicante Court, which is located in Elche. She was convicted of murdering her two-year-old son in Bigastro by suffocation after having routinely abused him, as she had done with her other sons.

The Court, which upheld the jury’s verdict, convicted her of one count of murder, another count of habitual abuse, and six counts of bodily harm. The Court considered the aggravating circumstance of kinship and the mitigating circumstances of confession, undue delay, and acting under the influence of drugs.

The convicted woman is required to pay €100,000 in compensation to each of the deceased’s two brothers, as well as an additional €10,000 to the deceased’s twin, for the injuries and after-effects he experienced as a result of the incident.

A house in the town of Bigastro was the residence of the mother and her children, who were two-year-old twins and a nine-year-old girl at the time, as indicated by the statement of proven facts in the sentence. The convicted woman struck the twins with a variety of objects on the head, torso, or extremities and shook them on at least six occasions, resulting in multiple fractures.

On June 11th, 2022, the woman returned from the park with the two children and, after putting one of them to bed, grabbed the other by the neck and squeezed him until he perished by strangulation, the attacks continued repeatedly, establishing a climate of peaceful disruption.

The jury determined that the defendant’s psychological state was exacerbated by her drug use since the age of 20, which had a detrimental impact on her willpower at the time of the homicide. The prosecution and defence concurred with the Prosecutor’s Office during the oral hearing, while the defendant acknowledged the facts. The Alicante Court’s sentence is not definitive and may be appealed to the Civil and Criminal Division of the TSJCV.
