Yesterday, Thursday November 26th, the Dénia plenary session voted on a proposal to stop issuing urban compatibility certificates for businesses and buildings connected to the growth of cannabis smoker associations and social clubs for a year, with the option to extend the time period. There was no issue responsible declarations or licences for work that is meant to make a building suitable for these purposes.
The legislation affects the urban centre area, which includes the neighbourhoods of Les Roques, Baix la Mar, Saladar, and Diana, as well as the Paris Pedrera region, Calle Marqués de Campo, and groups of sailors. It also impacts more outlying places like Torrecremada, the Camí del Cementeri, and Camí de Gandia.
Maria Josep Ripoll, the Councillor for Territory and Urban Quality, said, “We adopted this agreement because there are no specific rules that tell us what the legal parameters are for the correct location of these premises and the necessary facilities they must have to protect the rights and safety of the users themselves and the neighbouring residents.”
In this regard, the city council has started the process of regulating the establishment of cannabis social club headquarters “with the sole purpose of regulating and specifying exclusively urban planning aspects, defining construction parameters, as well as the type of minimum facilities and the technical conditions that the premises in which this type of activity is carried out must meet.”
The councillor stressed that “these are private premises accessed by members or associates, but they are also places where a certain number of people can stay for a short time, and they would have to be evacuated at the same time in case of emergency. They are also places where people can meet and have fun, but there is no specific regulation to ensure both safety and their proper functioning.”
The current usage of these buildings is in the tertiary sector, which is governed by the current planning rules. However, these rules do not include any specific rules for this type of activity. Ripoll says that a thorough study of the concept and the writing of rules to make sure it works with existing general usage are needed. This suspension of licenses will stay in place until the process of writing these rules is finished. This is to stop this kind of use from spreading.
