A grandfather who is 83 years old has been condemned to five years in jail in Alicante for sexually assaulting his granddaughter between 2009 and 2015, when she was between four and ten years old.
The Third Section of the Provincial Court of Alicante sentenced him to pay the girl 15,000 euros for the damages and losses she suffered as a result of the crime, as well as a stay of more than 500 metres and a nine-year ban on communicating with minors. He is also not allowed to work in any profession or trade that requires regular and direct contact with minors, whether he is paid or not.
The occurrences started in 2009 when the victim was four years old and the convicted man was 67 years old. According to the proved facts, the guy took advantage of the fact that he was in charge of picking up the little girl from school because her mother worked to touch her inappropriately.
The convicted man used his family ties to the girl to undress in front of her on several occasions, ask her to kiss him, and touch her private parts, the Valencian High Court of Justice (TSJCV) has reported.
The situation continued for six years and stopped in 2015, when the child was 10 years old. After a school activity about sexual abuse, she talked about what happened and realised that her grandfather had done this to her. The things that happened made the sufferer get post-traumatic stress disorder, which made them anxious and depressed.
During the oral trial, the guy who was found guilty denied the facts and said that he was never alone with the small girl while he was taking care of her while her mother worked. However, the court believed the child’s story based on the psychological reports.
The victim gave a “detailed, sustained over time and forceful” testimony and had no other reasons for doing so. As a result, a basic continuous crime of sexual abuse of a minor, abusing a family relationship, has been found to be true. This sentence is not final, and an appeal can be made to the Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community.
