The Alicante Court has sentenced a man to two years in prison for sexually abusing a guy he met at a nightclub after giving him a drink that contained a hallucinogenic chemical that caused him to become semi-conscious.
The decision, which was handed down by a Third Section court, states that he will not be imprisoned as long as he does not commit another crime within the following three years. It claims that the incident happened in San Vicente del Raspeig early on October 20th, 2019, when the defendant went to the recreational area with a friend who introduced him to the victim.
The victim declined the defendant’s proposal of sexual relations during a conversation, but he later offered her a drink of soda and alcohol that contained bufotenine, a serotonin derivative and a “psychedelic substance” that “can alter” perception and cognitive function, according to the sentence.
The victim started to feel sleepy after that, eventually going into a semi-conscious state and “daze” that the accused utilised to drive him to an empty truck parking lot and sexually abuse him.
The accused has acknowledged the facts and agreed to a two-year sentence for sexual assault “with carnal access” with the prosecution and the private prosecution. The sentencing also includes a distance of more than 500 meters for eight years and three more years of supervised release, with the mitigating circumstance of paying 9,000 damages.
