An 18-month fine was imposed by the Alicante Court on a man who was working as a nursing assistant intern at a private clinic in Benidorm for sexually assaulting a patient.
According to the judgement given by a court of the Tenth Section of the Provincial Court, the event happened at around 10:30 a.m. on April 26th, 2022, when the defendant escorted the patient to the dressing room where he was supposed to get dressed following the medical examination. He asked the patient there whether he needed assistance. The defendant exited the room after the patient said no. But he went back in and stood next to him. According to the court, he then “grabbed his penis” and “felt his testicles” after removing the patient’s pants.
During his testimony at trial, the defendant refuted the facts, claiming that the incident that was reported to him did not happen. Nonetheless, the court finds the complainant’s story to be credible because it was supported by the fact that he told his daughter what had happened right after the sexual attack.
Since the victim did not know the accused beforehand, the Alicante Court also rejects the idea that he had a malicious intent to hurt him. It also upholds the victim’s story as consistent and free of contradictions.
The defendant is given a fine of six euros per day for eighteen months. In addition, he has to pay the harmed party two thousand euros. Within ten days of notification, the decision may be appealed to the High Court of Justice of the Valencian Community (TSJCV).
