The Orihuela City Council has ordered the opening of disciplinary proceedings against the Local Police Commissioner, José María Pomares, for serious misconduct following the events described in complaints filed in April by an officer for alleged disobedience by the police commander.
The Castellón Local Police Commissioner has also been appointed as the investigating body for this procedure, and the Orihuela Local Police officer has been appointed as the secretary.
Furthermore, to ensure the effectiveness of this disciplinary resolution, precautionary measures such as the temporary assignment of duties to another position have been adopted. Specifically, a vacancy has been created for a General Administration Technician in the office on Calle Soleres to perform legal duties and draft ordinances related to citizen security, taking into account his legal training and professional experience.
This precautionary measure also aims to preserve order by preventing the continued issuance of circulars, orders, and changes of position, etc., as the complaint highlights, which violate the Local Police Regulations, the law, and the proper functioning of the service.
The City Council considers it the least burdensome measure, since the provisional suspension entails, for the duration, the loss of the pay corresponding to the specific supplement and bonuses for extraordinary services. The change of position, on the other hand, allows Pomares to continue working and receiving the full salary of his original position, without incurring financial loss, in addition to being able to enjoy the vacation days, personal matters, courses, and other leave he still needs to take before his retirement. It should be remembered that the commissioner is on vacation until he retires on September 18, despite having requested to remain active for two more years, until he reaches the age of 67.
This also avoids any relationship between Pomares and the complainant, as well as between the commissioner and the Councilor for Citizen Security, Mónica Pastor, and Mayor Pepe Vegara, whom he reported for alleged workplace harassment. The commission resolved this as a labor dispute, and it was appropriate to distance the parties.
The duration of his forced assignment to the other position is temporary and will end with the completion of the disciplinary proceedings or the retirement of the accused on September 18. In other words, he will retain his position as commissioner of the Local Police once the precautionary measure expires.
Finally, Pomares is required to hand over his uniforms, weapon, and Local Police ID to the Local Police headquarters this Monday, as well as the keys to the municipal vehicle, municipal computer and mobile phone, with their respective access codes, and the access codes to police management platforms or service communication channels.
Pomares now has ten days to submit his objections.
