The Alicante Provincial Court upheld a man’s conviction for burglary at a country residence in Petrer, Almafra Alta area. According to the punishment, the offender crossed the property’s fence and stole six sheets of iron formwork in April 2018, despite having no past criminal record.
Following a complaint from the owner that the material was stolen, the police investigated and discovered the plates at a nearby scrapyard, where they were sold the next day. The store employee recognised the accused as the individual who came in on a frequent basis to sell metal supplies, which served as proof to back up the accusation.
The guilty man challenged the initial sentence, claiming that the evidence was insufficient and that the statements were contradictory. However, the Provincial Court denied his appeal, ruling that the attribution of culpability was reasonable and that no unwarranted inferences were drawn.
Finally, the court upheld the six-month and one-day prison term, as well as a special exclusion from voting and payment of court costs. It also mandated the final restoration of the stolen property to the harmed party.
