The TSJCV (High Court of Justice of the Basque Country) acknowledged that Villajoyosa’s First Court of Instruction is currently investigating the possible commission of a crime of “failure to prosecute crimes” as part of preliminary proceedings 285/24. It further adds that eight local police officers from the town of Marina Baixa are being investigated and will be called to testify in court soon.
The events date back to 2023. The Guardia Civil investigated an intervention by the Villajoyosa Local Police for alleged offences of “domestic violence, threats, and possession of a weapon” with reference to a woman (NB) of Slavic heritage and her spouse (VK).
A cry for help was made at the end of March about possible mistreatment at the couple’s Villajoyosa home. The woman said her husband “was abusing her in front of their minor daughter.” Immediately after, Local Police stopped the family vehicle and discovered the woman crying with her small daughter inside.
The victim recalls receiving threats, including death threats recorded on her mobile phone, but does not offer specifics at the time. Furthermore, the woman informs investigators that her partner keeps a gun in the car. The police examined the safe in the vehicle and found nothing, but he has a small air gun at home, which the owner voluntarily relinquished.
The victim first chose against filing a formal complaint, choosing to return home with her daughter following the intervention. The polices filed a report and accompanied the victim to her home and the Guardia Civil, where the firearm was temporarily taken.
According to the case file, the man’s actions constitute a crime of threats under Articles 171.4 and 5 of the Penal Code, and there are indications of gender-based violence in the presence of the minor daughter. In fact, the victim has been rated and listed as “high risk” in the VPR system and the VIOGEN system since April 1, 2024.
Ultimately, the Guardia Civil had to arrest the man. There was a police record of the victim being followed and protected since 2018, allegations of past fights, and a restraining order directing him to stay at least 300 meters away, with electronic communication prohibited since March 2023.
According to the Vila Joiosa Guardia Civil’s inquiry, Local Police conducted rudimentary background checks but did not immediately verify the existence of any existing protection orders against the pair.
No immediate arrest was made; rather, provisional protection and referral to legal authorities were ordered. However, the action was distinguished by the victim’s accompaniment and the confiscation of the weapon, with the woman and minor’s safety taking precedence.
