The two minors charged with killing Cloe on the Orihuela might spend eight years in prison and five more years under supervised release. The Prosecutor’s Office and the victim’s family are both asking for this sentence for the crime of murder. In November, there will be a trial for this act of violence. It will take place across several days, and both defendants, the minor’s family, and the Guardia Civil officers who looked into the case will all testify.
On Tuesday, October 7th, everyone involved was called to the Juvenile Prosecutor’s Office to discuss the prospect of a plea deal because there was so much evidence against the two defendants. The courtroom called both the defence attorneys, Encarnación Obdulia Martínez and Iván Rodríguez Lorente, as well as the private prosecution attorney, Juan Carlos Fuentes. But both defence lawyers have failed to make a deal because the prosecution won’t offer any leniency, even if both defendants admit the facts. Both defendants are requesting the maximum penalty possible in juvenile court. According to sources close to the defence lawyers, they would have considered a plea deal if they had received a lower sentence. Both are being given the same sentence, with no extenuating circumstances taken into account.
The 15-year-old girl was killed on the Orihuela Costa, the day before the International Day for the Elimination of Violence against Women. Despite her severe injuries, the young woman managed to rise and seek help at her brother’s house. He took her to Torrevieja Hospital right away, but they couldn’t do anything to save her life. Cloe’s ex-boyfriend was the main suspect from the start, and he was taken into custody a few hours later.
The investigation did show that there was a second individual who helped him kill the victim, but he wasn’t detained until last March, four months later, when Guardia Civil agents had enough evidence against him.
A crime against women
The inquiry points to the possibility that one suspect held the young woman’s neck while the other cut her throat. The two defendants accuse each other of the murder. The young woman’s ex-boyfriend even said that it was a way to settle drug debts. The charges make it clear that this was a crime of domestic violence, in which the slain girl’s spouse got his friend to assist him in killing her. The claims say that the ex-boyfriend did the crime out of revenge because he couldn’t stand the fact that she had left him.
Court officials said that there is another case open in juvenile court against Cloe’s ex-boyfriend for the abuse he is said to have put her through when they were together. Cloe’s family has been trying to defend their name during the investigation and make it known that the young woman was not the victim of any mafia but of a jealous ex-boyfriend who couldn’t handle the split.
The crime shocked everyone, and there have been many memorial services this year. The two suspects and the young woman who died attended the IES Playa Flamenca school. The supposed accomplice was Cloe’s classmate in her fourth year of secondary school. Her ex-boyfriend was pursuing vocational training in the afternoon after dropping out of high school. The person who is said to have aided said that the young woman’s ex-boyfriend talked him into doing the crime by promising that he would be more accepted and popular in the group if he helped her.
The maximum penalty for major offences committed by teens between the ages of 14 and 17 is what both of them are looking for. Under the Juvenile Law, both of them will stay in a juvenile detention centre until they are 23, which is the maximum age for serving their terms. Since their arrest for their claimed role in the murder, both have been kept in a closed regime as a precaution.
The WhatsApp chats they sent each other to arrange the crime were one of the most important pieces of evidence against them. The defendants thought they had covered their tracks by sending messages that were deleted after being viewed. However, the Guardia Civil was able to get these messages back and piece together the talks they had on those days. Along with these signs that point to guilt, biological evidence was also revealed. For example, DNA from the victim was detected on things taken from the defendants. There were blood stains on a scooter, gloves, a helmet, and a shoe that belonged to the suspected accomplice.
This hearing could lead to a sentence for the murder of Cloe before December and before a year has passed since the crime.
