The Alicante Provincial Court has sentenced a woman to a maximum of six years in a psychiatric prison for killing her mother at the home they shared in Alcoi. The court took into account the fact that they were related and that she was mentally disturbed at the time of the crime.
The Superior Court of Justice of the Valencian Community (TSJCV) says that the punishment, which was agreed upon by all sides, first sends her to prison for six years and then keeps her in a psychiatric prison institution for no more than six years.
The prosecution and the defendant’s defence came to an agreement before the jury trial, which was supposed to happen on October 22nd, 23rd, 24th, and 27th but didn’t. This ruling is definitive and can’t be challenged.
The ruling says that the woman who was found guilty must first serve the security measure of being locked up in a psychiatric hospital before going to prison. It also says that the time she served under the security measure will count towards her prison sentence, as stated in Article 99 of the Penal Code.
“Proven Danger”
The ruling says that this decision is based on “the proven dangerousness of the accused” and the “need” for her to “receive adequate psychiatric treatment.” The lady who was found guilty will also have to serve four years of supervised release after she finishes her prison sentence.
The fight happened on September 20nd, 2022, at about 7:00 a.m. in the kitchen of the house where the convicted woman lived with her 65-year-old mother. The daughter then took a grill pan and beat the victim in the head and face hard enough to knock her out. Then she put her hands around the victim’s neck and choked her until she thought her mother was dead.
Soon after, the lady who had been found guilty realised that her mother was still alive and was trying to leave the house. She went up to her in the hallway, put a belt around her neck, and held her violently while bringing her back inside, where she stabbed her several times in the chest. The injuries from this last attack on her chest, which impacted crucial organs, caused the victim to die.
The verdict also says that it is proven that the lady who was convicted had a serious and long-term mental disorder at the time of the events that impacted her will and her understanding of what had transpired.
