A man answered the door to his house in Coín because the person ringing was the woman who typically cleaned his house. But as he opened the door, he saw a second person there who violently broke in and tried to rob him.
The victim, a 90-year-old man, was hit in the face and watched as they took not only his money but also many National Lottery tickets and the keys to his house.
The Provincial Court of Malaga has confirmed the couple’s five-year prison sentence, which was handed down by the Criminal Court No. 10 of the capital after a fast trial. The incident took place on April 20th of this year.
The court’s decision, which was appealed in June, said that the defendants, who were all working together and wanted to get something illegal, went to the old man’s house in Coín at about 7:55 p.m. on April 20th, 2025.
The lady who was accused of the crime took advantage of the fact that the victim trusted her since she had worked as a maid in his home before. She knocked on the door and requested that the man let her in.
He finally said OK, but as soon as he opened the door, the accused jumped out of hiding, walked into the building, and hit him in the face, leaving him on the floor.
The decision says that she held him still while the woman searched his pockets and removed his things. Finally, the defendants hurriedly departed the premises after taking the man’s personal papers, 100 euros in cash, his house keys, and five lottery tickets.
The Guardia Civil officers found both the keys and the lottery ticket because the accused had them with her when she was arrested.
Facial Injuries
This old person was hurt in the attack. Their lower eyelids were red and swollen in both eyes, and they needed medical care that took four days to heal. They didn’t get back the 100 euros or their personal papers.
The three judges of the Second Section of the Provincial Court confirmed the couple’s punishment for robbery with violence against people in a home. They each got five years in jail and had to pay the costs.
The man also had to pay a 2-month punishment (10 euros per day, or 600 euros in total) for a minor injury and another 198 euros for the injuries he inflicted, as well as return the 100 euros he took.
The accused cleaner’s defence said that she went to the property to collect money that the owner owed her for cleaning it, and she also said that she did not plan with the other accused to rob him.
The convicted man said that his friend didn’t know he was going to attack and rob the old man, but the judges don’t believe him and say that “there was an undeniable conspiracy” to do the attack.
The guy can appeal the sentence to the Supreme Court, but the Court has opted to keep him in jail until at least half of the five years he was given.
