The head of the number 3 Civil and Instruction Section of the Court of First Instance of Villajoyosa has decided to temporarily dismiss the case about the murder of a pilot who left the Russian Army, because the person who shot him has not been found.
The magistrate made this decision after getting a new report from the Judicial Police of the Guardia Civil that said, “it has not been possible to specify the material or intellectual authorship of the shots against the victim.” This decision is now final.
The 33-year-old man died on February 13th, 2024, after being shot multiple times at a residential complex near Avenida Rosa dels Vents in Villajoyosa.
The court that was on duty that day started preliminary processes to look into what happened. At first, they thought it might be a homicide or murder, so they kept the proceedings secret to preserve the investigation’s progress.
The Homicide Group of the Organic Unit of the Judicial Police of the Guardia Civil has done a lot of investigations, but they haven’t been able to find any evidence that would let them point the finger at a specific person or people as the intellectual or material authors of the crime.
The investigating judge’s ruling from September says, “After looking at the facts and considering the requirements that must be met for the commission of the criminal offence, it can be concluded that there is not enough evidence to attribute criminal responsibility to a specific person as the perpetrator, accomplice, or accessory of the events that have given rise to this case.”
So, the magistrate says, “the provisional dismissal of the proceedings must be agreed upon,” which is what she decides to do based on article 641.2 of the Criminal Procedure Law.
The case is therefore temporarily closed, but this does not mean that no further action will be taken in the future if new evidence or leads come to light that help find the person who is responsible.
