The police officers in charge of the case’s investigation were able to get a DNA sample from the physician who is currently in jail for allegedly raping a woman in Murcia while she was under anaesthesia.
The case report that was sent to the Molina de Segura Court, which is in charge of the inquiry, shows this.
The doctor, who was with the lawyer he had already hired (from a well-known practice in Murcia), chose to keep mute when asked questions at police headquarters.
He made this choice after meeting with his defence lawyer at the police station, which is something that everyone who is arrested has the right to do.
He just said that the investigators’ contact and location information were correct, as were his own.
He also said that he can read and write in Spanish, which is something that all detainees must be asked about in case they need a translator. He also said that he has never been arrested or charged with a crime before.
As for this last issue, the authorities sought to check it out in the suspect’s native country as well. To do this, the Family and Women’s Assistance Unit (UFAM) asked Mexico to transmit the doctor’s criminal record. Mexican officials got back to us and said that the doctor was not in their records.
The doctor wouldn’t talk, but he did let them obtain a DNA sample. He agreed “of his own free will and in front of his lawyers.” Getting biological samples from the suspect will assist the inquiry move further.
The doctor will be in the Sangonera prison over the holidays, but his defence plans to ask for his release.
The police took the doctor’s Apple iPhone 14, though. They told him to give them the password to unlock the gadget, but he said no.
The investigators have the phone. The force’s Technological Crimes Unit will try to get to the contents, but sources close to the investigation say it will be hard because Apple phones have a system that is hard to get into without the password, which the doctor won’t give.
The police ended their inquiry after the person did not make a statement. The day prior, the hospital’s operating room supervisor had given testimony about what happened. The nurses who captured the video told this professional about what happened; she did not see it herself. She added in her statement that they didn’t tell the patient anything because they were “faced with a situation that overwhelmed them, not knowing what to do, and finding everything that was happening surreal.”
The next morning, he was brought before the judge in Molina de Segura, who had the power to deal with violence against women (which now includes sexual violence since the law changed in the autumn). The judge decided to send him to temporary detention, where he would be in touch with the police and not get bail, as the alleged perpetrator of a sexual assault.
The doctor will probably spend the holidays in Sangonera prison, but his defence team plans to ask for his release while the investigation is still going on. According to sources at the prison, the suspect is still in the infirmary and has not yet been moved to live with the other detainees.
