The five people who are accused of kidnapping a man to get his brother-in-law to pay €350,000 for his release agreed to the charges and took responsibility at the opening of the trial after making a deal with the prosecution.
The court of the Second Section of the Provincial Court of Alicante, which tried the facts, found them guilty “in voce” based on that agreement. It then sentenced each of them to five years and six months in prison instead of the 21 years that the Public Prosecutor had asked for in his initial indictment.
Specifically, each of the five defendants will have to serve three years in prison for kidnapping, one more year for assault, and another year and six months for being part of a criminal group. This was agreed upon by both sides, and the charges of robbery with violence and illegal possession of weapons have been dropped.
Also, the defendants’ unreasonable delay and the need to pay for damages have been taken into account, since they had already put down 20,000 euros before the hearing to cover any civil liability.
The five people who agreed to take responsibility for the offences must pay the victim a total of 37,000 euros. This means that they must pay the remaining 17,000 euros in 24 monthly installments.
Facts
The events in question happened on May 27th, 2023, when, according to the first indictment from the Prosecutor’s Office, the five defendants went to Villajosoya, where the victim lived, and forced him to get into a car after displaying to him what looked like a pistol.
They beat him up and stole his phone and other things while they were driving him to a residence in Santa Pola, where they stayed for two days before relocating to another house in Yecla, Murcia. During that time, the defendants called the victim’s brother-in-law and demanded 350,000 euros, threatening to kill the man they were holding hostage.
The Public Prosecutor further says that the defendants kept the victim tied up, didn’t feed him properly, didn’t give him the medicine he was taking, beat him, and shocked him with a taser gun.
