The Provincial Court acquitted a 26-year-old man of attempted stabbing a fellow boarder in Alicante, saying that a complete defence of mental aberration or abnormality should be used. Defence attorney Alejandro RodrÃguez Vidal demanded detention at a psychiatric institute, while the prosecutor’s office requested an incomplete defence.
According to the Second Section’s judgement, the defendant is ordered to be interned for medical treatment for paranoid schizophrenia for a term of not more than fifteen years, less one day, without regard for the progress of his treatment. The Prosecutor’s Office requested a five-year internment period and the use of the imperfect defence of mental condition. In addition to the internment, the Court ordered that he be placed on probation for five years after serving his term in a psychiatric hospital, and that he pay €12,900 in damages to the stabbing victim.
The events described in the sentence occurred around 7:00 p.m. on April 19th, last year, at a boarding home on Doctor Ayela Street in Alicante. The defendant, who suffered from a significant mental handicap that prevented him from recognising the illegal breadth of his actions, approached a 24-year-old guy with two knives while he was eating supper in the boarding house’s dining area and stabbed him multiple times.
The accused acted “guided by the desire to take the life of the young man,” with whom he had previously disagreed, and in one of them, he even threatened to kill him.
The man was brought to Alicante General Hospital in severe condition after receiving four stab wounds to the chest and another to the belly. He underwent surgery. According to the verdict, if the young guy had not gotten immediate medical assistance, his life would have been jeopardised.
