The Alicante Court fined a 44-year-old man for transmitting sexual photographs to his partner’s two minor children, with whom he lived in Benidorm. The two fines total 3,240 euros each. The images were stickers delivered via WhatsApp that featured obscene photos of genital organs.
The trial concluded with a plea in Alicante Court, where the defendant admitted to both sending the photographs and assaulting one of the youngsters with a broomstick. When the incidents occurred, the two children were juveniles, ages 13 and 15, respectively. The messages were sent on June 25th, 27th, and 29th, 2021, as well as July 13th, 14th, 16th, and September 17th of the same year. The biological father of the two youngsters filed the complaint.
The Tenth Section determined that the stickers showed genital organs and a man having sexual contact with a woman. During his trial testimony, the defendant consented to these facts following a plea bargain with the prosecutor’s office.
In light of this agreement, the court finds him guilty of two consecutive offences of sexual provocation, punishable by an 18-month punishment of 6 euros per day, for a total of 3,240 euros per offence.
Abuse
The defendant also admitted to domestic abuse for beating one of the two kids during an argument over his refusal to turn over some headphones. On July 25th, 2021, the defendant struck his partner’s son in the leg with a broomstick.
The court ordered him to conduct 60 days of community service and issued a restraining order directing him to stay at least 300 metres away from the minor for two years. It also imposed a two-year and six-month prohibition on carrying a weapon and sentenced him to pay €200 in compensation. The decision is final and cannot be challenged.
