A 46-year-old Colombian man was sentenced to three years and nine months in prison for stabbing his ex-girlfriend and her current partner in the street in Benidorm. The incident resulted in non-life-threatening injuries, and he was charged with gender-based violence. The sentence, however, has been mitigated and substituted with deportation from the nation, with the guilty person barred from returning to Spain for eight years. The sentencing is the outcome of a strong collaboration between the Prosecutor’s Office, private prosecution, and defence.
The attacks took place at 8:15 p.m. on May 3rd, at the door to the defendant’s former partner’s home on Benidorm’s central Avenida Europa. According to the ruling, the defendant arrived at the house with a knife. When he discovered his former partner’s current partner at the door, he “stabbed her in the head” without saying anything. The incident happened in May, and just over four months later, the defendants were convicted and punished. The defendant was in pretrial confinement, so the proceedings moved quickly.
The victim attempted to flee and sought refuge inside the building, but the defendant proceeded to assault him with the knife and punches. At this time, his old partner attempted to intervene and was stabbed in the abdomen.
Agreement
At a hearing on September 22nd, the defendant pleaded guilty to the double attack. Following the plea agreement, the defendant was sentenced to three years in jail for his first offence of assault, as well as a six-year restraining order directing him to stay at least 300 meters away from the victim. Finally, the court ordered him to pay €660.40 as compensation for the losses.
The sentence also includes an additional nine months and one day in jail for a second offence of assault in the context of gender-based violence for the assault on his ex-partner, as well as a four-year restraint of more than 300 meters and the payment of €652.80 in compensation.
The court confirmed the substitution of the terms for expulsion from Spanish territory, “with the inability to return to Spain for eight years,” but warned that in this situation, he would have to complete the entire sentence issued. It further ordered that the convicted person be placed in pretrial detention until the expulsion proceedings were completed.
