The Alicante Criminal Court No. 5 acquitted three suspects of drug trafficking, disputing proof of their involvement in the cultivation and subsequent distribution of marijuana shipped to the Netherlands. The three defendants, one of whom was represented by lawyer Aitor Esteban Gallastegui, faced a request from the Prosecutor’s Office for three years and six months in jail.
The verdict establishes as established facts that the three defendants were examined by the Alicante National Police following the discovery of two parcels containing 22 kilogrammes of marijuana and shipped to the Netherlands in May 2021.
Industrial hemp
However, the court verdict notes that it has not been established that one of the defendants, the owner of a company dedicated to industrial hemp that does not exceed the limits of tetrahydrocannabinol (THC), the psychoactive substance, grew the drugs seized in the packages.
It further suggests that the other two defendants distributed the marijuana through the contacts of a Dutch citizen who is also charged in the case but was proclaimed in absentia in June.
According to the verdict, one of the two defendants engaged a parcel delivery firm in San Vicente del Raspeig to convey the two items to the Netherlands and deposited them there without knowing what was inside.
According to the ruling, the sender was listed as a corporation operated by the third defendant, who was unaware of its activities, but the contact phone number was that of the Dutch defendant, who is in absentia.
