A defendant has been sentenced to nine months in prison for assault and battery and ordered to pay €27,000 in compensation for striking an individual in the face at a pub in Alicante. Subsequently, he was required to endure surgery at the hospital for facial fractures.
At first, the Prosecutor’s Office and the private prosecution, which was led by attorney Luis Santamaría, requested a two-year prison sentence and €48,000 in compensation. However, defence attorney Aitor Navarro García reached a plea agreement that included a reduction of the sentence to nine months and a reduction of the compensation to €27,000. The ruling mandates that the penitentiary sentence be suspended for a period of three years.
The events that were proclaimed as proven in the sentence took place on the terrace of a pub situated on Avenida Pintor Xavier Soler in Alicante at approximately 1:00 a.m. on May 18th, 2023. The victim engaged in a conversation with the defendant regarding his interest in the former’s fiancée, as per the ruling.
After the conversation, the victim proceeded to another table on the pub’s terrace. Suddenly, the defendant approached him and delivered a powerful strike without uttering a word, resulting in his fall to the ground.
The victim sustained injuries from the strike, including a fractured right jaw, necessitating surgery, and began to bleed from his nose and mouth.
