After his 29-year-old partner gave birth to their baby at the Vinalopó hospital in Elche (Alicante), a 38-year-old man was sentenced to four years and nine months in jail.
In front of a court in the First Section of the Provincial Court of Alicante this Friday, the accused, a citizen of Mali, admitted the facts and accepted the prison sentence for a crime of attempted murder. The events took place on April 9th, 2024, in room 2012 of the aforementioned health centre, where his partner was admitted after giving birth to a new child, the fourth in common, three days earlier via caesarean section.
After the victim deposited 15,000 euros in a French bank as payment for the damages, the public prosecutor’s initial sentence of 14 years in prison was lowered by the agreement with the prosecution and the private prosecution.
Taking into consideration both the aggravating circumstances of discrimination based on gender and kinship and the mitigating circumstance of compensation of damages, the court rendered an oral guilty finding. The decision also includes a restraining order that forbids the defendant from communicating with the victim for ten years and the termination of his parental rights over their four children.
The prosecution’s accusation states that the woman told the defendant she wanted to permanently end the relationship after the couple argued about money management at approximately 8 p.m. on April 9th.
He tried to murder his partner by sneaking in early in the morning.
The public prosecutor claims that the condemned man refused to accept that ruling and returned to the family’s Elche house, where he got a knife and a hammer to return to the hospital and sneak into his partner’s room at around 4:17 a.m. then used the knife he was carrying to stab her in the neck while she was asleep. The victim woke up and attempted to protect herself by using her hands to stop the stabs, but the man kept stabbing her in the head and shoulder while stating, “I don’t want to lose you,” until hospital staff heard her cries for assistance and came to her aid.
On April 10th, the accused was taken into custody and placed under remand. In the meantime, the woman waited 33 days to heal from injuries that could have been deadly if she hadn’t received medical help right away.
