The Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community (TSJCV) has upheld the acquittal of a woman who was accused of stealing money from the elderly woman she cared for. This confirms the sentence given by the Eleventh Section of the Provincial Court of Alicante, which is based in Elche.
The Valencian High Court judges turned down the private prosecution’s appeal against the acquittal. The Public Prosecutor’s Office had also joined the appeal.
The Alicante Court looked at the information provided during the trial and decided that it was not shown that the accused took 107,668 euros from the victim’s bank accounts between 2020 and 2021 without her permission and kept the money.
It was not proven who made the bank transactions.
Because of this, the trial court found the woman not guilty of severe breach of trust, misappropriation, and fraud. It also said in its decision that the old woman was in charge of her own money and could get to it directly.
The High Court of Justice has now confirmed that conclusion, saying in the appeal ruling that there is no proof that the accused made the wealth transfers that the accusations say she did.
The judges said in their decision, “There is no proof that the accused did these things or that they knew the access codes to the complainant’s bank accounts.”
