The Alicante Court sentenced a waiter at a Benidorm pub to five years in prison for stabbing someone in the neck. According to the information obtained by this publication, the establishment’s customer was addressed after an argument. The court finds him guilty of attempted murder after discovering evidence that the defendant jumped from the bar and attacked the victim in the neck with a sharp weapon, which the judges felt was homicidal in nature.
The Prosecutor’s Office first sought an eight-year prison sentence for attempted murder against the waiter at a Benidorm pub suspected of attempting to kill a man during a dispute on October 2nd, 2022. The punishment is slightly less than the one sought by the Public Prosecutor’s Office. The activities took place in the early hours of the morning at a leisure facility on Calle Gerona. The court finds it proven that, during the dispute, the defendant left the pub armed with a sharp item and stabbed the victim in the neck. The injured person underwent many surgeries and took 36 days to recover from the wounds, which left him with multiple scars, among other injuries.
Initial confession
The defendant first confirmed the facts to the authorities but later reversed his statement, declaring himself innocent, and his defence attorney sought to have this self-incrimination deleted from the proceedings. The defence attorney raised this question at the beginning of the trial. The court considered this testimony along with the victim’s statement, in which she identified the defendant but did not attend the trial. She did, however, testify in court as part of the incident inquiry.
Although the victim had no idea who had attacked him, he was approached from behind. However, the court determined that the accused was responsible because he had not argued with anyone else in the establishment. The court determined that it was a surprise attack and, more importantly, that there was a purpose to kill, considering that the injuries occurred in the neck area. One of these slashes may have ended the victim’s life. Despite the absence of the weapon, the language suggests that it was a sharp object.
The verdict is not final and can be appealed to the Valencian Community’s High Court of Justice.
