A police officer from Villajoyosa has been given a six-month fine, with a day price of 6 euros, for hurting a man he had been arguing with after the person said the officer wasn’t doing a good job of controlling traffic.
The Tenth Section of the Provincial Court of Alicante, also ordered the police officer to pay the pedestrian 4,980 euros for the damage done on October 6th, 2021, at about 2 p.m. when the defendant was directing traffic on the Avenida del País Valencià in Villajoyosa, which is a busy road.
The police officer said during the trial that a passerby told him, “You have no f***ing idea how to direct traffic.” This led to a back-and-forth of insults until the pedestrian decided to leave and the officer followed him, demanding that he show his ID card while grabbing his left wrist and twisting it.
The ruling shows that the pedestrian had a 65 percent physical disability, which made it hard for him to get the paperwork, and that the officer’s grip on his wrist caused a sprain at the radius, for which he needed a plaster splint and a 49-day recovery period.
The police officer said in court that he grabbed the victim because he didn’t follow his instructions and had disrespected a police officer, but he insisted that he had not grabbed him by the wrist but by the forearm.
However, the court trusts the victim’s story and thinks the injuries are substantiated based on the medical reports that were given. This decision can be appealed to the High Court of Justice (TSJCV) within ten days.
